By accessing or using LingoForge ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

LingoForge is an AI-powered exam preparation platform that provides:

• TOEFL and IELTS practice tests and mock exams
• AI-powered speaking and writing grading
• Performance analytics and progress tracking
• Study materials and practice questions
• Personalized learning recommendations

3. User Accounts

To use the Service, you must:

• Be at least 13 years of age
• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use
• Be responsible for all activities under your account

4. Subscription and Payment

LingoForge offers subscription-based access:

• Subscription plans are available for various durations (1 week, 1 month, 3 months, 6 months)
• Payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled
• You may cancel your subscription at any time
• Refunds are handled on a case-by-case basis
• One subscription per exam type per user

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Reverse engineer or attempt to extract source code
• Share account credentials with others
• Use automated tools to access the Service
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to our systems
• Copy, modify, or distribute our content without permission
• Use AI-generated feedback for academic dishonesty

6. Intellectual Property

LingoForge retains all rights to:

• Platform design and functionality
• Practice questions and test materials
• AI grading algorithms and feedback systems
• Text, graphics, logos, and software
• Trade secrets and proprietary technology

You retain ownership of your practice responses and personal data, but grant us a license to use it for providing and improving the Service.

7. AI Grading and Feedback

Regarding AI-powered grading:

• AI grading is provided for practice and learning purposes
• Feedback may not perfectly match official exam scoring
• We continuously improve our AI systems but cannot guarantee accuracy
• Use AI feedback as a learning tool, not as official score prediction
• Official exam scores may differ from our AI assessments

8. Content and Materials

Our practice materials are:

• Designed to simulate real exam formats
• For educational and practice purposes only
• Not affiliated with or endorsed by ETS, Cambridge, or other official exam boards
• Protected by copyright and intellectual property laws

9. Service Availability

We strive to maintain high availability but:

• The Service may be temporarily unavailable for maintenance
• We do not guarantee uninterrupted or error-free operation
• We are not liable for service interruptions
• We may modify or discontinue features at any time

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL LINGOFORGE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to indemnify and hold harmless LingoForge from any claims arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account:

• For violation of these Terms
• For fraudulent or illegal activity
• At our sole discretion with or without notice
• Upon your request (account deletion)

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
